California’s latest worker laws arrive as employers are embedding automated signals into performance, surveillance, and restructuring decisions. For talent leaders, the issue now reaches beyond legal compliance into manager capability, workforce planning, vendor dependence, and the evidence a chief financial officer will expect when training spend competes with hiring, automation, and delay.

The oddity in California’s new employment laws is that they keep automated systems inside management. They make the human layer harder to fake.

Senate Bill 947, signed by Governor Gavin Newsom on September 30, 2026, and operative July 1, 2027, does not prohibit employers from using automated decision system outputs in discipline or termination decisions. It prohibits sole reliance. The chaptered text states, “An employer shall not rely solely on an ADS when making a disciplinary or termination decision.” That sentence functions less as a ban than as a diagnostic. It exposes the weak point in many automated management workflows: a human is present, but the human role may lack the competence, documentation, or independence needed to carry legal and operational weight.
