A proposed DHS rule has reopened a problem many enterprises treat as immigration administration rather than workforce design. For employers with significant sponsored technical talent, restructuring choices may soon carry a narrower margin for preserving scarce capability and project continuity. The budget question now reaches beyond replacement cost to something many talent systems cannot yet show: whether a viable internal move can be identified, validated, and executed before a separation decision closes the window.

1. A status buffer has been carrying more workforce risk than most restructuring plans admit
The current visa grace period has been doing workforce planning work even though it does not authorize work. Covered workers can generally be treated as maintaining status for up to 60 days after employment cessation, or until the end of their authorized validity period, whichever is shorter, subject to DHS discretion. During that period, workers may pursue options including a change of status or a petition to change employers.
For enterprises, that time creates room for decisions that may not have been resolved before employment ends.
